SHILLONG: The Shillong Bench of the Gauhati High Court has directed the Steering Committee Against Murder Of Democracy (SCAMOD) to reply to the affidavit filed by the police questioning the stay on the order issued on September 27 last by Justice (retired) SP Rajkhowa who is heading the inquiry commission probing into the Shillong Jailbreak incident (May 31 2009).
SCAMOD had filed the writ petition questioning the order issued by Rajkhowa to put an end to the hearing by the Commission.
The court on Tuesday had asked Agnes Kharshiing, convenor, SCAMOD, to file the rejoinder on behalf of SCAMOD within two weeks.
Meanwhile, the court has also maintained that the interim order on this matter would continue till the next date of the hearing on November 31.
In his order, Rajkhowa had earlier decided not to examine anymore witnesses but to proceed ahead with the arguments.
Meanwhile, in the writ petition, SCAMOD has pleaded that their counsel should be allowed to examine Sub-Inspector RA Sangma who conducted the first inquest on the body of the slain ringleader Fullmoon Dhar.
It may be mentioned that there were two inquests carried out on the body of Dhar. The second inquest was carried out by First Class Magistrate HS Diengdoh.
SCAMOD have also pleaded to allow its counsel to examine the Forensic Science Laboratory (FSL) examiner from Guwahati, the doctor who conducted the second post mortem after the body of Fullmoon was exhumed and also the dealing assistant who pasted the white paper on the file relating to the DGP’s transfer.
