Case related to undisclosed ownership of petrol pump

SHILLONG: The final hearing of the case against Williamnagar independent legislator Ismail R Marak in connection with the allegation that he concealed the fact about owning a petrol pump will be held in Gauhati High Court, Guwahati this Wednesday.
Informing this here on Saturday, Ismail Marak’s lawyer Sujit Dey said that the allegation made against the legislator is totally false since he had already declared that he owned a gas filling station at Nangalbibra during the filing of nomination for the 2008 election.
“I dismiss the allegation against Ismail R Marak as baseless and without proof. He has a petrol pump but the same was already mentioned in the nomination papers in 2008,” Dey said.
He also informed that three individuals (Escon Marak, Sunen Marak and Gilbert Sangma) who claimed to be from Rongram had filed a complaint with the Governor RS Mooshahary seeking the disqualification of the legislator on May 15, 2010.
After receiving of the complaint, Dey informed that the Governor had sought the opinion of the Election Commission in August 2010.
After receiving the opinion of the Election Commission, the Governor in his notification dated September 30, 2010 dismissed the complaint by the three individuals since it was not maintainable.
After this notification of Mooshahary, he informed that the three individuals filed a writ petition at Gauhati High Principal Bench on January 19, 2011 which is pending in the court for disposal.
Dey also informed that Nangsen G Momim made allegations against Ismail after seeing a report which had appeared in a section of the media on March 22, 2010 alleging that Ismail did not mention the petrol pump he owned, while filing his nomination.
Nangsen filed a complaint with the Indian Oil Corporation requesting to cancel the petrol pump license.
He also lodged a complaint with the East Garo Hills Deputy Commissioner. After the Williamnagar legislator had demanded for an unconditional apology on March 3, 2011 it was later found that there was no person by the name of Nangsen.
Dey also informed that a civil case was also filed against the newspaper which printed the report in March 2011 with the Assistant District Judge demanding compensation of Rs 1 crore for coming out with such unfounded allegations in the paper.
