SHILLONG: Based on the recommendations made in the 14th Report of the Law Commission, the State Government would soon establish a separate Directorate of Prosecution for the effective conduct of prosecution in heinous cases as well as in all criminal and civil cases.
“We would soon table the proposal for creation of the Separate Directorate of Prosecution in the Cabinet for its approval and the same is in its final stage,” official sources said on Sunday.
According to sources, the main objective of constituting an independent Directorate of Prosecution is to ascertain whether the materials collected during the course of investigation are sufficient to make an accused stand trial in the court of Magistrates and Sessions Judges, to advance evidence and to submit effective arguments to bring to book the real culprits.
“The Directorate would be responsible for conducting the prosecution in all the courts in the state and would have the liberty of scrutinising the evidence in all the cases prior to their filing in the courts,” the official source said adding that the Directorate would also ensure that the investigation is conducted in accordance to the law.
The Directorate would be headed by a director, who would be the overall supervisory authority of the prosecution in the state. Replying to a query, official sources admitted that the creation of this separate directorate has been lying pending for a long time.
