Kohima: The 33 per cent reservation for women in the municipal bodies in Nagaland has been exempted as various committees of the Nagaland Legislative Assembly (NLA) rejected the implementation of the Act in the state.
Nagaland Minister for Urban Development Dr Shurhozelie on Saturday moved the resolution, which was tabled yesterday, which said the select committee of the NLA set up to review the entire Nagaland Municipal Act 2001, had recommended that the Assembly should pass a resolution to frame its own laws for conduct of Municipal and Town Council Act in lieu of Part (IX)A of the Constitution which specifically refers to granting 33 per cent reservation to women. The recommendations of the select committee, which was tabled by the Chairman of the Committee and Minister for Parliamentary Affairs T R Zeliang stated that the seven-member committee had, in its second sitting, ‘unanimously resolved to reject the applicability of Part IX (A) of the Constitution of India and further recommend to the NLA to pass a resolution by the Assembly to frame own laws for conduct of Municipal and Town Council Act in lieu of Part IX (A) of the Constitution’.
The committee further said it is of the ‘strong opinion that Part IX (A) of the Constitution of India contravenes the provisions of the Article 371(A) of the Constitution of India in respect of the state of Nagaland’. Part IX (A) deals with reservations to women and others in urban local bodies enshrined in the seventy fourth Constitutional amendment.
The report stated that the recommendations were made after examining in detail all the representations of the Naga social organizations.
After thorough deliberation, the committee unanimously agreed to recommend a resolution to be adopted by the NLA, rejecting the applicability of Part IX (A) of the Constitution of India, it said. (UNI)
