Tripura CJ issues direction for police, doctors

Agartala: Chief Justice of High Court of ripura expressed displeasure over police functioning in the state especially in investigation of criminal cases.

A Division bench of the High Court comprising Chief Justice Dipak Gupta and Justice Subhashis Talapatra Tuesday issued a 12 -point directives to Tripura police and medicos to be followed while dealing with criminal cases.

While announcing judgment on an appeal petition against life term imprisonment of one Mrinal Bhowmik in South Tripura who was accused of killing his wife in brutal torture for dowry, CJ Justice Gupta observed that police did not register case even after approaching police.

Moreover, during treatment of the victim who had been admitted with serious burn injuries in the hospital doctors were not also informed the police over the incident that ultimately led the High Court to set free all the accused including Mrinal.

In observation of the case, division bench directed the Chief Secretary, Director General of Police and Principal Secretary (Health) to file an affidavit by May 6 stating that the directives issued to police and doctors were notified and widely circulated.

The direction includes immediate intimation to police from the hospital as soon as any patient comes with injuries in criminal incident, immediate treatment should begin in the hospital, recording the statement of the victim by police in local language and get it approved from the victim.

Moreover, in serious criminal offences (where provision of more than two years imprisonment) police should not wait for written FIR, doctors are also duty bound to record the statement of victim to facilitate the police and in critical case police should be accompanied by a magistrate while recording the statement.

Meanwhile, police was directed not press anybody to write FIR even oral information has to be registered as FIR, police should not wait for written complaints in heinous crime and immediately after getting FIR it has be forwarded to magistrate. (UNI)
