Parl panel for setting up of SC benches in states

New Delhi: The Parliamentary Standing Committee on Law and Justice has strongly recommended establishing Benches of the Supreme Court at other places in the country.

It said the argument against more SC benches that it would require cumbersome process of judicial amendment and endanger unity, was wrong and untenable.

The unity and national status of the Supreme Court would remain intact even if other benches were created, like in the case of High Courts as several of them have more than one bench and there are some which have jurisdiction over more than one state.

It said more benches of the Supreme Court could be created in consonance with Article 30 of the Constitution.

In this connection, the Committee noted that the number of pending cases was mounting in India.

It advised the government to conduct a comprehensive study of the working of the Supreme Court as compared to those of other countries in order to identify grey areas.

It said the present judge to population ratio of 15.5 judges per million population was grossly inadequate to dispense justice in a reasonable time, which is also the reason for high pendency of cases.

It strongly recommended appointment of more judges to enforce rule of law and curb corruption. (UNI)
