Contempt case filed against YMCA Gen Sec, city SP

SHILLONG: The Meghalaya High Court (MHC) vide an order dated Nov 7, 2013 has drawn contempt of court proceedings against DL Warjri, general secretary, YMCA (Young Men Christian Association), Shillong for willfully misusing its earlier order dated Oct 21, 2013 passed by the Division Bench in Writ Appeal No. 18 of 2013 and also for willfully violating the order dated Oct 30, 2013 passed in Misc. Case No. 336 of 2013. This was confirmed by SAIIC lawyer, S Jindal here on Friday.

The case relates to a land possession dispute between YMCA and Sri Aurobindo Institute of Indian Culture (SAIIC).

It may mentioned that the YMCA general secretary on early morning of Oct 30 dismantled a portion of the SAIIC boundary wall using a JCB claiming “Consequent upon the decision of the Meghalaya High Court dated October 21, 2013 in the Writ Appeal No. 18 of 2005, we shall make a proper entrance into our land at Bivar Road, Shillong adjacent to your property by breaking a portion of the wall alongside the main road on October 30, 2013” in his letter addressed to the SAIIC on Oct 29, 2013.

SAIIC however alleged that YMCA encroached upon the property of SAIIC, forcibly by taking undue advantage of the impugned order of MHC and also misinterpreting the said judgment.

The said demolition was carried out in the presence of ADM, police personnel, SAIIC devotes and lawyers.

A court stay was later granted on the very day of demolition to maintain status quo and allow SAIIC to file a Special Leave Petition in the apex court. “The Nov 7, 2013 MHC contempt of court case against YMCA has also directed Warjri not to further misuse and violate the order / orders of the MHC,” said Jindal.
