SHILLONG: The court of the Judicial Magistrate (first class) will pass the order on the bail application moved by CSWO president Agnes Kharshiing on two cases relating to the recent eviction drive conducted at Umsawli last week, on Tuesday.
Maintaining that the objection raised by the Investigating Officer (IO) to the bail moved by Kharshiing is not justifiable the court said that bail may be granted to the accused but with strong conditions. The court stated that the order will be passed on Tuesday.
When contacted, the CSWO president’s lawyer Poonam Yadav said that the bail application for both the non-bailable cases filed by MUDA and a driver of a JCB on Friday last were kept in abeyance since Saturday when the bail was moved following a direction by the court to the IO to submit the case diary to be produced on Monday.
“The bail plea was not rejected as mentioned in some news reports, it was kept in abeyance,” Yadav said adding that the final order of the case, which was heard on Monday after submission of the IO’s report, will be passed on Tuesday.
According to her, the objection to the bail made by the IO was vague and the court maintained that bail can be granted to Kharshiing as per a provision laid down under CrPC which allows bail to women even in case of non-bailable offences.
Kharshiing was arrested on Friday for allegedly obstructing an eviction drive conducted by the Meghalaya Urban Development Authority (MUDA) at Umsawli village.
Meanwhile, the CSWO on Saturday filed a counter FIR against MUDA Secretary T Lyngwa and Additional District Magistrate DM Wahlang besides others who undertook the eviction drive at the New Shillong Township on Friday.
This was followed by another FIR filed by a resident of Umsawli, Jropsila Kharkongor who lodged a complaint at Rynjah PS that on November 8, Magistrates T. Lyngwa, D.M Wahlang and I. Majaw along with others illegally trespassed and demolished two of her shops at Umsaw.
