SHILLONG: Woman activist and CSWO president Agnes Kharshiing, who was arrested for allegedly obstructing an eviction drive conducted by MUDA at Umsawli area at New Shillong Township (NST), was denied bail by a local court on Tuesday.
The court of First Class Judicial Magistrate R R Rimbui denied bail to Kharshiing based on the report submitted by the investigating officer of Sadar Police Station where cases were registered against her.
Immediately after the verdict was pronounced, a petition was filed on behalf of her in the court of sessions Judge A Ripnar under Section 439 of CrPC challenging the order of Rimbui.
Accepting the petition the Sessions Judge sought records and the case diary and the matter is likely to come up for hearing on Wednesday, informed public prosecutor IC Jha.
He said that Section 439 of CrPC was cited as it has provisions to grant bail.
Earlier in the day, the court of the first class judicial magistrate rejected the bail application moved by the CSWO chief in connection with two cases relating to the eviction drive conducted at Umsawli last week.
Confirming this, East Khasi Hills Additional District Magistrate DM Wahlang said that Kharshiing was denied bail as the evidences collected by the Investigation Officer (IO) substantiated the allegations levelled against her by the MUDA authorities and a driver of a JCB on Friday. The CSWO president’s lawyer Poonam Yadav had on Monday stated that the bail application for both the non-bailable were kept in abeyance since Saturday when the bail was moved following a direction by the court to the IO to submit the case diary to be produced on Monday.
