Court asks CBI to seize MUDA papers

Violation of by-laws by 12 building owners

SHILLONG: The High Court of Meghalaya on Friday asked the CBI to seize all the documents pertaining to granting of permission by the Meghalaya Urban Development Authority (MUDA) to the owners of as many as 12 high-rise buildings of the city.
The High Court passed the order while responding to a PIL filed by a city-based lawyer Jonathan Thangkhiew.
It was on April 11 this year that the High Court in an interim order had prohibited constructions beyond G-plus three (ground floor and three additional floors) in Shillong following the violation of the building rules framed by MUDA.
The concern of the Court was that there is a rampant construction of high-rise buildings in hilly terrain like Shillong which falls under Seismic Zone 5.
Later, the High Court formed a committee to examine the cases of violation of the Meghalaya Building Byelaws, 2011, in under-construction buildings.
The names of the twelve persons (builders) found place in the report of the committee.
They are Narayan Prasad Jhunjhunwala at Police Bazaar, Nilesh Tibrewalla at Thana Road, Satyabrato Baidya at Jail Road, Ajit Das Gupta at Jail Road, Bidur Das at Jail Road, Uday N. Shukla at Oakland Road, Rajkumari Sinha at Bivar Road, Mentok Ri-Project Pvt. Ltd at Bivar Road, Maruf Elahi at Bivar Road, Beroline Khongshei at Laban, Mohendro Rapsang at Keating Road and Saini Pala at Motinagar
The Court had earlier directed MUDA not to issue completion and occupancy certificates to theses builders besides issuing an order that the alleged violators should not sell their flats in the twelve buildings to any intended purchasers by concealing the facts.
