SHILLONG: After the Bill which bars MLAs from holding the post of MDCs was sent to the Advocate General K S Kynjing for his opinion on Tuesday night by the Governor V Shanmuganathan, it was sent back to the Governor on Wednesday after fulfilling the necessary formalities.
An official source said on Wednesday that the Governor had forwarded the Bill to the Advocate General only to know his opinion before giving his approval to it.
The source added that the mind of the Advocate General was the same as that of the Government which facilitated Assembly passing the Bill during the autumn session on Thursday last.
The Assembly passed the Bill with effect from October 1 and even if the Governor gives his assent to the Bill a few days later, the Bill will have the retrospective effect from October 1, a legal expert said.
The Governor was busy on Wednesday after he took additional charge of Manipur on Wednesday.
“The Governor is still examining the Bill”, a source from Raj Bhavan said. After the Governor gives his assent, the same will be notified in the official gazette.
Meanwhile, the Under Secretary to the Governor of Meghalaya has clarified that the Governor’s remarks on Tuesday was on seeking the views of the Ministry of Home Affairs pertaining to the Khasi Hills Autonomous District (Village Administration) Bill, 2014 and not on the Prevention of Disqualification (Members of the Legislative Assembly of Meghalaya) Amendment Bill, 2015.
