‘Govt’s dual post Bill unauthorized’

SHILLONG: President of the Meghalaya Commercial Truck Owners and Operators Association, Augustine Shanpru has termed the Government’s move to pass the Prevention of Disqualification (Members of the Legislative Assembly of Meghalaya) Act, 1972, as unauthorized.
Supporting his claim Shanpru said that till date no law prevails in India that prevents an MDC from becoming an MLA.
“The Act has no scope of dragging District Council into its purview or cause disqualification to any MLA or MDC due to a mere mention of the word member of the District Council in the Act,” he said adding that the term office of profit is confined only to members of Parliament and Legislative Assembly and excludes members of the District Council.
According to him, the State cannot pass a law until and unless it gets passed by the Parliament and the Constitution is amended.
He observed that the Chief Minister Mukul Sangma should consult legal experts on the recently passed bill.
