Dual-post case hearing deferred to Dec 15

SHILLONG: The hearing of the dual-post case scheduled for Tuesday in the High Court of Meghalaya was postponed to December 15 in the absence of amicus curiae P.K. Rai.
The High Court did not constitute the full Bench for Tuesday since the Amicus Curiae was absent.
After the postponement of the case on Tuesday, the case was initially listed for December10. As the senior Supreme Court lawyer M N Krishnamani, appointed by the Governor’s Secretariat, has to attend a case in the apex court on the same day, the hearing was deferred to December 15.
Source said on Tuesday that the Supreme Court lawyer Krishnamani came to Shillong to attend the scheduled hearing on Tuesday after postponing a case in the Supreme Court to December 10.
Earlier on Monday, the Special Secretary, Law had filed an affidavit before the Court stating that the Meghalaya Governor had referred the dual post matter to the Election Commission of India  for feedback before deciding on the disqualification of MLAs who were holding the post of MDCs.
The affidavit of Sangma was in response to the order of the High Court of Meghalaya on November 24 which said that there should have been some communication from either the Secretary of Governor or Advocate General whether the Governor had referred the dual-post issue to the Election Commission of India or not.
While KHADC CEM PN Syiem still continues to hold the post of MDC being MLA, seven legislators had quit the post of MDCs following the dual post Bill which came into force from October 1.
