SHILLONG: The High Court has deferred hearing on the pending PIL on dual post for four weeks as the Election Commission is still examining the matter.
When the matter came up for hearing on Wednesday before the full bench of the High Court headed by Chief Justice Uma Nath Singh, the Advocate General, BP Todi sought the adjournment of the case on the ground that the Election Commission was still examining the matter.
The issue relates to eight legislators who were holding the posts of MDC.
It may be mentioned that the High Court had asked the Meghalaya Governor V Shanmugananthan to decide on the matter after taking up the issue with the Election Commission of India, at the same time the High Court directed the Governor to include all the eight legislators who were holding the posts of MDC while referring the matter to the Election Commission.
Except KHADC CEM P N Syiem, seven legislators- H.D.R. Lyngdoh, Ardent Miller Basaiawmoit, Stephanson Mukhim, Phlastingwell Pangniang, Brolding Nongsiej, Metbah Lyngdoh and Sanbor Shullai- relinquished the posts of MDC fearing disqualification in the wake of State Government making the dual-post Bill effective from October 1, 2015.
In the order passed last year, the Full Bench of the High Court had made it clear that irrespective of the dual-post Bill brought by the state government, the matter involving eight legislators, who were occupying the posts of MDCs, will be heard on merit.
