SHILLONG: For the Election Commission of India, the matter related to the disqualification of KHADC CEM P.N. Syiem for holding dual posts is still a secrete document.
The Election Commission in a recent reply to an RTI query by Agnes Kharshiing, the mover of the PIL on dual posts, said the Commission examined the matter after the Law department forwarded her RTI application to the former.
The Commission said that after a reference was received from the Meghalaya Governor as per Article 192 (2) of the Constitution as referred to the Governor by the State government on November 28 last year seeking disqualification of Syiem, the case is under process.
“The reference case is under process and the same has been considered as secret document till the passing of final order by the Governor,” said N.T. Bhutia, Under Secretary, Election Commission.
According to the Election Commission, in pursuance of the section 8(1) (i) of the Right to Information Act, 2005, the referred case is exempted from disclosure till the Governor passes his final order.
