SHILLONG: The High Court of Meghalaya on Thursday directed petitioner Deoris Marbaniang to implead the Garikhana Branch of Vijaya Bank as one of the respondents in the case relating to pending dues of Rs 10 crore that the State Sports Council owes to Marbaniang’s company.
Receiving the lower court order, the High Court said as per the August 17 order, “nobody could definitely say that the amount of Rs 4,96,06,179 has been frozen by Vijaya Bank, Garikhana Branch”. The petitioner’s counsel was directed to take necessary steps to implead the bank as one of the respondents.
Last year on November 20, an execution order was issued by a lower court following a petition filed by Marbaniang, the owner of M/s Funya Sports, stating that the Sports and Youth Affairs Department owed the firm over Rs 10 crore for supplying sports materials.
The Department had filed a petition in the court of the assistant to Deputy Commissioner requesting a stay on the execution order.
The firm has been supplying sports materials like medals, trophies and jerseys since 1992. The matter goes back to 2003 when a writ petition was filed in the High Court by the firm claiming Rs 2. 19 crore for the bill submitted.
On Thursday, G.S. Massar, senior counsel for the Meghalaya State Sports Council, prayed that the case pending before the Court of the Assistant to DC be called for and the registry was asked for the record immediately. Later, H.S. Thangkhiew, senior counsel for Marbaniang, prayed that he would like to move a petition for impleading Vijaya Bank as a party. The matter has been listed again on Friday for case record and further order.
