SHILLONG: The High Court of Meghalaya has asked the State counsel to file an affidavit if the latter feels that the education scam case cannot proceed simultaneously in the High Court and the apex court.
In the past, the petitioner’s lawyer, N. Syngkon, had maintained that the petition filed by Agnes Kharshiing with the High Court seeking CBI probe into the criminal aspect of the education scam was different from the case pending in the Supreme Court.
According to the petitioner, the matter pending before the Supreme Court relates to challenging the earlier High Court order of constituting the High-Level Scrutiny Committee while the case pending in the High Court is regarding the FIR filed with the police seeking action against those involved in the scam.
However, during the hearing on Thursday, the State government, which is against any further CBI inquiry into the education scam related to the pending criminal case, has been asked to file the affidavit before the High Court since the government counsel had submitted that the apex court has been apprised of the similarity of the case.
The amicus curiae, K. Paul, and State counsel P. Nongbri submitted that the issue involved in the case had already been brought to the notice of the apex court and hence this case cannot continue simultaneously.
However, Judge S.R. Sen directed the State counsel to file an affidavit in this regard and listed the matter to be taken up on Monday.
