Job reservation: Govt to file review petition

SHILLONG: The government has decided to appeal against the recent order of Judge S.R Sen on the aberrations of the state reservation policy.
On July 19, after hearing a few petitions filed by deserving job applicants from the general category for various posts in the Prisons Department, the single bench of the court said the state reservation policy should be strictly adhered to and the government cannot divert the seats or posts from one category to another.
An official source said on Wednesday that the Prisons Department had sought the views from various government departments with a plan to file a review petition in the High Court.
The source added that by filing an appeal, the government wants to make clear its stand that general category means open category and the job aspirants from any category can compete. Currently, 40 per cent of jobs are reserved for Khasi and Jaintia, 40 per cent for Garo, 5 per cent for other backward classes and 15 percent for the general category.
Following the court order, the state government had also sought the opinion of the Advocate General.
Currently, candidates irrespective of castes and tribes can compete in the open category which is also called general category and they are appointed based on merit.
In the order, the court had reminded the government that the Constitution of India does not desire more than 50 per cent reservation and a nationalistic view should be taken so that no one is deprived of his or her rights.
