SHILLONG: The High Court of Meghalaya has stayed the eviction drive order issued by the Deputy Commissioner, (Revenue), West Garo Hills, Tura. During a hearing on the matter, the court heard K. Paul, counsel for the petitioner as well as H. Kharmih, State counsel.
The counsel for the petitioner submitted that without following the due process of law, the impugned order dated September 4 was issued by the Deputy Commissioner, (Revenue), West Garo Hills, Tura.
He also further contended that the previous order passed by the court in two writ petitions of 2015 has totally been ignored, so necessary directions may be passed.
On the other hand, the State counsel submitted that the eviction of the unauthorised occupants is necessary as the land is required for important projects.
He also contended that the petitioner has no locus standi to file this instant Miscellaneous Case. The counsel for the petitioner was directed to ask whether the petitioner is authorized by all the occupants to move this petition.
After hearing the submissions advanced by the learned counsel, the September 4 order was hereby stayed till the next date.
The matter has been listed after puja vacation for hearing on the maintainability of the petition and further order.
