HC asks police not to harass woman in paternity case

SHILLONG: The High Court of Meghalaya has issued a notice to an Investigation Officer of the Laban Police Station to appear before the Court along with the case diary in a paternity dispute.
During the hearing, the court heard N Mozika, counsel, appearing on behalf of the petitioners as well as S Sen Gupta, additional senior government advocate, appearing on behalf of the state.
The counsel for the petitioners submitted that there was a paternity dispute during the lifetime of the deceased father of the child who is aged seven months’ old, so he lodged an FIR with the officer in charge at Laban Police Station and thereafter, the Investigation officer sought permission to take the blood sample of the child and to send it for DNA test.
The counsel also informed the Court that the Judicial Magistrate has just passed a one line order without applying any judicial mind and now, almost every day the petitioner is called upon by the Investigation officer to go to Ganesh Das Hospital for collection of blood sample of the child.
The Court issued notice to the Investigation officer concerned to appear before the Court along with the C.D and in the meantime, the officer was directed not to call the petitioner for collection of blood sample of the child, till the matter is decided by the High Court.
The matter has been listed for hearing on October 17 for case diary, appearance of the Investigation Officer.
