HC rejects interim bail plea of Assam MLA accused of rape

GUWAHATI:  Gauhati High Court on Wednesday rejected the plea for interim bail by All India United Democratic Front (AIUDF) MLA from Algapur Assembly Constituency in Assam, Nizam Uddin Choudhury who has been accused of rape by a 19-year-old woman.

Rejecting the interim bail plea of the MLA, the High Court has directed the police investigation team to submit the case diary to the court on July 18 next.

Meanwhile, Assam police is yet to question the MLA though  it have arrested  the woman’s husband Sahid Ahmed Laskar from  Guwahati airport on Saturday evening as he was to board a Mumbai-bound flight.  The woman accused her husband of colluding with the MLA.

The 19-year-old woman accused that MLA  Nizam Uddin Choudhury had raped her on two occasions on May 19 at the Government Circuit House in Hailakandi and on May 23 at her home.

On the basis of the complaint lodged by the woman, the police has registered a case (No.529/18) under IPC Sections 376 (rape), 342 (wrongful confinement) and 35 (collusion) against the MLA and her husband.

The woman in the FIR alleged that she was taken to the MLA at the Circuit House in Hailakandi by her husband on May 19, where she was raped by the legislator. Again on May 23, her husband brought the MLA home and the latter raped her as her husband left her alone with the MLA.

The MLA has denied the allegation and termed it an attempt to tarnish his image. He said the woman and her husband had problems between them and he was trying to help them to resolve after the mad had sought his help.
