Director seeks quashing of FIR

SHILLONG: After the lady proprietor of Sanjo Medical located outside the NEIGRIHMS, filed an alleged molestation and corruption case against D M Thappa, the Director of NEIGRIHMS, he has sought the intervention of the High Court of Meghalaya to quash the FIR.
During the hearing of the matter on Friday, the bench headed by Chief Justice Mohammad Yaqoob Mir cited that the petitioner sought quashing of the FIR filed in Rynjah police station against him by the lady pharmacist.
The allegation is that the petitioner,
Director NEIGRIHMS in the morning hours on February 4 this year visited her shop opposite to NEIGRIHMS for cordial discussion and advised her to carry out the business as per his instructions. Further, the FIR mentioned that he has cleared her bill for supply of pacemaker and some commission may be shared with him and he also tried to kiss her but she was a bit uncomfortable though she has not taken his approach seriously as in their culture they greet each other by kissing cheek. However, she clearly refused to share the commission with him, that is the only reason for which he has harassed her.
It was contended that the allegations levelled are concocted because on February 4, the petitioner was in Delhi in connection with official works. In support of this submission, copy of a letter on February 1 by the petitioner addressed to the Additional Secretary, Union Ministry of Health and Family Welfare annexed with the petition revealed that the petitioner had to proceed to Delhi on February 3 for attending the office of the Ministry of Health and Family Welfare on February 4 forenoon for various official matters and thereafter he had to attend another meeting of the SEC (Dermatology & Allergy) in New Delhi on February 5. Further, in support of the letter, air ticket has been annexed revealing that the petitioner had left on February 3 from Guwahati and departed from Delhi on February 6 at 9.30 am .
Advocate General pointed out that the lady complainant has subsequently addressed a letter to the Chairperson, Meghalaya State Commission for Women, conveying that there is a clerical error in her complaint on February 3 so as to show that the incident has taken place on February 1 instead of February 4.
The court asked the Advocate General to produce the case diaries for perusal of the court on May 20.
The court said in view of the position, proceedings of Rynjah police case will remain in abeyance till the next date of hearing and notice has also been issued to the respondent.
