Documents reviewed in KHADC meeting

SHILLONG: The second meeting of the Advisory Committee on Legislation and Legal issues was held on Monday where a number of documents were reviewed.
Among other things, the Committee was constituted to examine and advise the Executive Committee of the KHADC on issues concerning powers of Para 3 of Sixth schedule vis-à-vis terms of the Annexed Agreement of the Instrument of Accession (IOA).
The committee on Monday reviewed a number of documents and discussed the relevance of the five exemptions in the Annexed Agreement relating to judicial powers, excise, forest, land and water rights and revenue derived therefrom, Revenue, Khasi & Jaintia territory includes  (boundary), and Legislation (which required special arrangements, modifications).
There were discussions on application of central legislation over the Khasi States under the IOA and Annexed agreement wherein there is presently no reflection within the Constitution of India.
On the other hand, the committee also turned to Para 3 of Sixth schedule of the Indian Constitution vis-à-vis recent draft amendment. The committee discussed proposed  draft  amendments and felt further deliberations were needed.While on the other hand, Panchayats are exempted under Article 243 of the Constitution, the Article 244 (2), the issue of Para 12 A(b) of Sixth schedule and Meghalaya regulation of Land Transfer Act, 1972 were also discussed.
The need for clearly defining the Dorbar Shnong, Dorbar Raid and Dorbar Hima in the Sixth Schedule were also discussed.
