NEHU accuses NEHUTA of holding office

SHILLONG: The North-Eastern Hill University has said that despite several directives, the North-Eastern Hill University Teachers’ Association (NEHUTA) continues to hold office “unconstitutionally” and continues to send communication to university, media and others.
“The term of the Executive Committee (2019-2020) has already expired (early May, 2020) in accordance with the Clause 8 of the Constitution of NEHUTA,” the NEHU said in a statement on Monday.
The NEHU has also reiterated that the election committee of NEHUTA is invalid and the Executive Committee 2020-21 is unconstitutional and null and void.
“It may be pointed out that NEHUTA Constitution cannot override the NEHU Act and Statute, and the NEHUTA Constitution is subservient to the NEHU Act. According to Statute 44 of the NEHU Act and Statute, the Teachers’ Association has been established and its functions should be in accordance with the provisions of said Statute 44,” it said
The NEHU also said that any communication sent by the NEHUTA office-bearers to the University or media or to any meeting/proceedings of the meeting of the general body/election committee after May 7, 2020, has no locus standi.
Earlier, NEHU had said the executive and election committees of NEHUTA are unconstitutional and invalid. “Despite being aware that NEHUTA’s executive committee’s term was over (including that of president’s and general secretary’s), both the ex-president, XP Mao, and ex-general secretary, MM Khymdeit, continued to sign and quote themselves purportedly as president and general secretary, NEHUTA, in all notifications/representations/letters to the University, the media and others from mid-May till date. This is tantamount to manipulation and also violation of the NEHUTA Constitution. Hence, the election committee is unconstitutional and the election of the new executive committee of NEHUTA (2020-21) is null and void,” the University had said in a statement in June.
