SHILLONG, Jan 13: The state Congress is preparing to file a petition in the High Court of Meghalaya against the merger of three Congress MLAs with the NPP, once the court reopens later this month.
A Congress functionary revealed that the matter is in progress, with the party’s legal counsel currently drafting the necessary documents for submission to the court.
“Once the High Court resumes after the vacation, we will file the petition. The process is under way, and our lawyer is preparing the case,” the Congress functionary stated.
It has been five months since the three Congress MLAs merged with the NPP, prompting the former to repeatedly signal its intention of pursuing legal action.
The three MLAs—Celestine Lyngdoh, Gabriel Wahlang, and Charles Marngar—defected from the Congress to join the NPP in August last year.
The Congress had earlier submitted multiple petitions to the Assembly Speaker, citing Paragraph 2(1)(a) of the Tenth Schedule of the Constitution.
Speaker Thomas A Sangma has upheld their merger with the NPP as valid.
