Cop death probe: HC rejects 4 bail pleas

SHILLONG: The High Court of Meghaya on Monday rejected the bail applications of Kynsai Jones Nongkharai, Andy Robert Basaiawmoit, Homestar Jamu  and Kamphermay Kharsati, who have been  named in the FIR filed by the Special Investigation Team (SIT) probing the death of Sub Inspector PJ Marbaniang in Patharkhmah earlier this year.
During the hearing, the counsel of the accused said that since the case was registered under the Prevention of Corruption Act, 1988 and it has nothing to do with the murder of the police officer Marbaniang.
On the other hand, while opposing the bail applications the state government counsel submitted that for the purpose of investigation custody of the accused person was necessary and at this stage, “if pre-arrest bail is granted, the entire investigation will collapsed.”
After hearing both the counsels, the court rejected the bail applications.

In the last hearing, the High Court had rejected the anticipatory bail plea of as many as 11 people named in the FIR filed by the SIT. Earlier, the SIT reached the conclusion that pressure was exerted on Late Marbaniang after he detained 32 coal-laden trucks in Patharkhmah.
The SIT also arrested five persons including a Block Development Officer and members of the FKJGP Western Zone for alleged abetment to ‘suicide’.
SIT also filed as many as six FIRs with Nongpoh police against 30 people including government officials and police personnel from Patharkhmah police outpost and the Jirang BDO for illegal collection of money from coal trucks.
