Dual-post PIL hearing deferred

SHILLONG: The Full Bench of the High Court of Meghalaya will take up the dual post PIL on November 19.
During the hearing on Monday, the lawyers for the respondents had sought three weeks’ time.
The court later suggested November 19 as the next date of hearing which was agreed upon by both the parties.
During the hearing, the lawyers for the respondents cited the case of Mizoram where there is no controversy over dual post,  but the Court wanted the lawyers to focus on the Meghalaya case.
There was also a reference from the lawyers of the respondents that the matter relates to the Sixth Schedule of the Constitution, while the Court pointed out that Constitution is the mother of Sixth Schedule.
During the earlier hearings, the High Court had asked the Governor to decide on the dual post following which the Assembly passed the dual post Bill prohibiting MLAs from holding the post of MDCs.
Later, the Governor gave assent to the Bill and subsequently it was notified.
