Court notice to Govt on drug peddler arrest

SHILLONG: The court of the Assistant District Judge has issued a notice to the state government on Wednesday to file a written statement regarding the arrest of a person in the name of drug peddling, whereas he was acquitted by the Special Judge (NDPS) since there was no evidence of his involvement.
The petitioner Khamkap Simte, who languished in jail for almost two years, has sought a compensation of Rs 15 lakh for the  false implication in the NDPS case in 2013 by the police.
The compensation sought by Simpte  was for  loss of business, reputation, bodily and mental pain and expenditure incurred for court case.
The lower court has asked the home department to ensure the appearance of  East Khasi Hills SP,  officer in charge  of Madanriting police station, and Investigation Officer during the next hearing on December 22.
Earlier, the government had  acknowledged that the accused was acquitted “due to the technical irregularities on the part of prosecution”.
It was on January 20, 2013 that police based on the FIR filed by the then Additional SP (Crime ) had  arrested five persons alleging them to be drug peddlers from Madanriting.
The police seized heroin weighing 69.87 grams from their possession which were concealed in 60 small-sized golden tobacco tin cases.
Besides, Simte, others who were arrested included  Niang Simte of Madanriting, Hginthian Siam and Nangnelam Simte of Kahilipara, Guwahati  and Vungaih Simte of Lamka, Churachandpur, Manipur.
