Cabinet nod to Meghalaya Apartment Ownership Ordinance, 2015
Shillong: Aiming to regulate ownership of apartments and flats in the city, the Meghalaya Cabinet on Tuesday approved the Meghalaya Apartment Ownership Ordinance, 2015.
Speaking to media persons after the Cabinet meeting, Chief Minister Mukul Sangma said the State government has come out with the Ordinance since it feels that there should be legislative mandate for regulation of ownership.
The chief minister said the Ordinance would enable the government to ensure that the provision of Meghalaya (Transfer of Land) Regulation Act, 1971, applies and while applying the provision of this particular law, it also would enable the owners of the apartments to protect their interests in respect of interest inheritable and transferable based on the formula that notional value of the land on which the apartment stands would be assigned to the owner, he added.
Urban Affairs Minister Ampareen Lyngdoh shared a few highlights of the Ordinance, which aims to provide for the ownership of an individual apartment in a building together with an undivided interest in common area facilities. Basically this would indicate maintenance, management and equal responsibilities and contributions for the same for all owners of the apartments.
The Ordinance also zeroes down on the roles of the developers and owners, formation of associations and systematic provisions for the formation of such associations.
The Ordinance also looks at the notion value and subsequent calculations for registration, distribution of the common profits of the property and also provides for the provision of penalty for any contravention of the rules and provisions by an individual or group; and to include promoters’ associations or apartment owners.
Amendment of departmental exam rules
The State Cabinet also approved the amendment to the rules for conduct of departmental examination for police officers.
On the proposal of the Home (Police) department for amendment of the Rule 5 of the Rules for the Conduct of Departmental Examination,1982, for police officers, Home Minister Roshan Warjri informed during the press briefing that the proposal was adopted and approved by the Cabinet.
