Hearing on Marbaniang case deferred

SHILLONG: The High Court of Meghalaya has listed the matter pertaining to the petition filed by the mother of late Sub Inspector P.J. Marbaniang for the next hearing.
The High Court has granted both the parties – Dorothy Marbaniang and the State government – to apprise the Court of any order passed by the Sessions Court, Nongpoh.
Stating that the Court had indicated in the order passed on October 27, 2015 “that several flaws so contended by N. Syngkon, learned counsel for the petitioner, can be effectively put up before the learned Court of Sessions at the time of consideration of the charge. It is clear under the CrPC that if the concerned Court of Sessions is not satisfied with the charge sheet submitted by the concerned authority for reason that there are several flaws in the charge sheet, the learned Court of Sessions can pass appropriate order for further investigation or any order which deems appropriate.”
The High Court would now seek the status of the order passed by the Sessions Court.
It may be mentioned that late P.J. Marbaniang was found dead under mysterious circumstances at his official quarter on January 25, 2015.
HC to hear Lokayukta case on Jan 28
The High Court of Meghalaya has fixed the next hearing on the Lokayukta issue on January 28 on the request of Advocate General B.P. Todi.
The State government had filed a Special Leave Petition before the Supreme Court challenging the stay of the High Court on a non-judicial member becoming the Chairperson of the Meghalaya Lokayukta.
