Shylla finds loopholes in 1973 Town Planning Act

SHILLONG: UDP MDC H.S Shylla has said the Meghalaya Town and Country Planning, Act, 1973, has loopholes and is creating confusion in scheduled areas.
The UDP MDC said the provisions in the 1973 Act are similar to the 1959 Act of Assam that deals with government land. However, in Meghalaya, land belongs to an individual, and the Raid and not the government.
Also, the Act is for areas outside the jurisdiction of the Autonomous District Councils (ADCs).
“It is creating confusion as it stated that the Act shall extend to the whole of Meghalaya excluding the Autonomous Districts which means that the Act is operational only in normal areas,” he said.
He added that none of the ADCs in the State – KHADC, JHADC and GHADC, had approved the Act of 1973. The State Government does not have the resolution which was passed by the three ADCs that they have approved the Act of 1973 at the time when  the notification of January 13, 1989, was published, the MDC claimed.
Shylla met the Minister of Urban Affairs Development on April 6 and he is awaiting a response by this week on revoking the 1989 notification.
In this case, the MUDA Building Bye Laws will be cancelled.
