SHILLONG: The High Court of Meghalaya has pulled up GHADC for expressing inability to make payments for the last one year to its retired employees.
Though the case was related to the delay in payment of pension benefits to a petitioner, the division bench comprising Chief Justice Dinesh Maheshwari and Judge VP Vaish observed during the hearing on Wednesday that a broader question has arisen as to “whether it is at all permissible for the respondent – GHADC, said to be an Autonomous District Council established under the Sixth Schedule of the Constitution of India, to suggest that they are not in a position to make any payment for at least one year”.
According to the court, the suggestion by GHADC of the breakdown of constitutional machinery appears unacceptable.
The court reminded that four more such writ petitions filed by retired employees of GHADC are pending in the high court.
The Chief Justice will hear these petitions for appropriate orders.
The matter will be heard after two weeks.
