DC promulgates Sec 144 Cr PC against burning of forests, garbage

 TURA: The West Garo Hills District Magistrate has promulgated an order under Section 144 Cr P C prohibiting burning of agricultural field, forest, meadows, grassland etc., and burning of plastic, leaves, garbage etc., in villages and town area of the district with a view to protect the environment and also to protect the health and hygiene of humans and animals.

The order has been imposed in view of the reports received that farmers are burning the agricultural fields and grazing lands which causes harmful effect on the soil organic matter, macro and micro nutrients, physical properties of soil texture, colour as well as soil biota. Further in the long run soil may be rendered useless and can lead to severe pollution of the air and smog as was witnessed in the national capital.

Anybody violating the order is liable to be prosecuted under section 188 of IPC and under specific acts governing the above mentioned provisions namely, the Environment (Protection) Act 1968 and other relative acts and rules made there under, the DC said.

The order, which is directed to the public in general will come into force with immediate effect and shall remain in force for two months unless modified or rescinded earlier.

Due to exigency in nature and circumstances of the matter, the order is being issued exparte under section 144 (2) of Cr PC 1973. However, anyone aggrieved by it may approach the competent authority for modification/waiver/alteration/rescission of the order, he further informed.
