SHILLONG: The High Court of Meghalaya has asked the trial court in Ri Bhoi to allow Meghalaya Infratech Private Limited & others to file a written statement regarding the dispute over a land meant for the construction of five star hotel at Khanapara.
The Infratech had filed a revision petition before the High Court of Meghalaya against the denial of the trial court to receive the written statement.
The respondent Margareth Khyriem, a resident of Nongmynsong, Shillong, pleaded that she had purchased land from Pristila Mynsong by executing a sale deed. She applied for change of mutation of the ownership which had been accorded by the Syiem of Hima Mylliem and land documents were issued in her favour and the land was registered.
According to Khyriem, the defendants ( Infratech) have encroached into the land and though there was repeated request to vacate it, the defendants did not accede to her request and instead claimed the ownership of the property.
The defendants, however, pleaded that the land measuring 19,525 square meters was transferred to them by way of sale located at Khanapara by Shaikordor Rumnong and Rymphang Pohshna for setting up of the five star hotel.
The court of Chief Justice Ajay Kumar Mittal, after hearing both the parties, stayed the order of the lower court and allowed the revision petition by the defendants.
The court ordered that the defendants are allowed to place the written statement on record within fifteen days from the date of appearance before the trial court.
