SHILLONG: The Meghalaya High Court on Tuesday directed the State Government to file its counter affidavit within four weeks with regards to the order of the West Garo Hills District Magistrate in January this year for booking GNLA chairman Champion Sangma under the Meghalaya Preventive Detention Act (MPDA), 1995.
Champion’s counsel Sujit Dey had moved the court on the matter and it was listed before Justice SR Sen.
During the hearing, Champion’s counsel pointed out the irregularities in the booking of Champion under the MPDA and also pointed out violation of the rights of his client by the West Garo Hills District Magistrate.
Dey also pointed out that the detaining authority had violated the fundamental rights of his client as he was not produced before the Advisory Board as per Section 12 of the Act.
“Provision of the MPDA was not followed,” Dey said, while adding that the MPDA order was not approved by the State Government as per Section 3 (3) of the Act.
After hearing the petition, Justice Sen issued a notice to the State Government to file its counter affidavit within four weeks.
