SHILLONG, Sep 15: As the ongoing brouhaha over the government’s intention to implement Code of Criminal Procedure (CrPC) and Code of Civil Procedure (CPC) across the state persists, the Khasi Hills Autonomous District Council (KHADC) has decided to convene a meeting of the various traditional heads of the various Himas, the magistrate of the district council court and its legal counsel on September 21 to discuss the notification on CrPC and CPC.
Talking to reporters after the meeting the MDCs on Thursday, KHADC Chief Executive Member (CEM) Titosstarwell Chyne said that they will take a final decision during the meeting after consultation with all the stakeholders including the heads of the additional subordinate courts and the village courts.
“We would be inviting the legal counsel from the state government as well as the council to clarify to this notification as far as implementation of the CPC and CrPC in the tribal areas is concerned,” he added.
According to him, the thought process of the state government and the KHADC are on the same lines.
The CEM pointed out that the state government has made it very clear that there is no question of diluting the power of district councils or interfering with village courts or changing the procedure in district council courts.
“As far as cases between the tribals are concerned, the Law department has clarified that the district council will continue to be adjudicated by the district council courts since they have been empowered under provision under para 4 and 5 of the Sixth Schedule,” he said.
