SHILLONG: Annoyed over the laxity on the part of the Criminal Investigation Department (CID) of the State police, the Law department has asked the CID to challenge the Supreme Court’s interim order granting anticipatory bail to the Chancellor of CMJ University, Chandra Mohan Jha.
An official source on Wednesday said following up the civil case against CMJ University filed by former Meghalaya Governor RS Mooshahary, the Law department had filed a vakalatnama (authorized an advocate to argue the case on behalf of law department).
However, while dealing with the criminal case, the CID failed to file a caveat (a warning so that the case can be heard in the presence of all the parties) to prevent any ex- parte or one sided judgment by the Supreme Court regarding the bail application of Jha.
Since the CID did not file any caveat, the Supreme Court went ahead with the ex-parte judgment which became favourable to the accused, resulting in Jha getting relief in the form of an anticipatory bail.
The official source said that the CID could still challenge the case, as granting bail by the Supreme Court was an interim order.
In this context, the Law department has written to CID to take immediate steps to challenge the order of the Supreme Court regarding Jha.
