SHILLONG, March 27: A Special POCSO Court in East Khasi Hills on Friday has sentenced a 70-year-old man to 30 years of rigorous imprisonment along with a fine of Rs 50,000 for committing repeated sexual assault on his minor daughter.
The convict was found guilty under Section 5(1)(n) of the POCSO Act, punishable under Section 6, read with Section 506 (Part II) of the IPC.
Pronouncing the judgment, Special Judge (POCSO) M.K. Lyngdoh stated that, after considering both mitigating and aggravating circumstances, the court awarded 30 years’ rigorous imprisonment along with a fine of Rs 50,000. In default of payment, the convict will undergo an additional six months of imprisonment.
The court also sentenced the convict to seven years’ imprisonment with a fine of Rs 10,000 under Section 506 (Part II) IPC, with an additional three months’ imprisonment in case of default.
Taking into account the survivor’s background and the need for rehabilitation, the court directed the Meghalaya State Legal Services Authority to provide compensation of Rs 5 lakh to the survivor. It may be noted that the survivor who was 12 years old at the time of the incident in 2013 was subjected to repeated sexual assault by her father. The case was registered under Mawsynram Police Station.
The prosecution was led by Special Public Prosecutor Evalarisha Rynjah, while the investigation was carried out by WPSI B.M. Marak.
