HC grants bail to man held for possessing cannabis

SHILLONG: The High Court of Meghalaya on Thursday has granted bail to one Shanborlang Jala who was reportedly arrested with 1.07 kg of cannabis (ganja) in his possession.

While granting the bail, the court admonished the Investigating Officer (IO) for failing to file charge sheet in the case within the stipulated 90 days. The court also had tough words for the Special Judge (NDPS), Shillong for remanding the accused in custody without the remand report of the IO.

The High Court held that the Special Judge (NDPS), Shillong had passed the order of remand whimsically and without applying his judicious mind.

The court also held that filing of charge sheet in NDPS case involving commercial quantity and intermediate quantity are 90 days and 60 days respectively.

The judgment will be binding on all the subordinate courts in Meghalaya.
