Meghalaya High Court frees one arrested in 2011

Police blamed for poor investigation

SHILLONG: The High Court of Meghalaya has acquitted one Krishna Bahadur Thapa, who was arrested by police for allegedly carrying some contraband items in his vehicle while proceeding towards Mizoram on March 8, 2011.

While passing the judgement on Friday, the Division Bench comprising Justice TNK Singh and Justice SR Sen castigated police for faulty investigation saying “either they (police) had done it intentionally or due to lack of knowledge.”

Acting on the specific information, police had intercepted two vehicles (MZ 01 F 3632 and MZ 01 F 7535) driven by accused Thapa and another co-accused L Varte at Luckier Road, Shillong.

One female occupant sitting in the vehicle driven by Thapa was also arrested.

Both the vehicles were brought to Lumdiengjri Police Station, thereafter they were taken to office of Additional S.P (Crime) wherein a carton was recovered from the vehicle registration (MZ 01 F 7535) which contained 500 Diazepam injection.

Police after investigation of the case filed chargesheet against all the accused persons before the court of the Special Judge, Shillong Under section 22 (C) of NDPS Act.

Earlier the Special Judge (NDPS) B.Giri, Shillong convicted the accused KB Thapa and awarded 10(Ten) years of RI. Giri also convicted the female accused Lalimpuii Khiangte under section 27 NDPS Act but her sentence was set off talking into account that she already spent in jail for 2(Two) years while another co-accused Lalborole Varte was acquitted.
