SHILLONG: In a relief for the real owners of a plot at Rynjah, the Advocate General ruled that city based advocate, Ranabir Choudhury who had procured a plot of land in his name at Rynjah, had done so by misrepresentation of facts.
The Advocate General as per Rule 26 under the Land and Revenue Regulation, stated, “This is a case where Ranabir Choudhury had misrepresented facts in order to obtain the lease agreement in his name aided by the then president of the Welfare Society of the colony after the decision of the Hon’ble High Court. Considering the facts and circumstances of the case action is to be taken as per Settlement Rules 26 which is relating to confirmation and cancellation of settlements.” Choudhury had acquired the piece of land at RR colony, Rynjah which was purchased by one Prabhasini Dutta from (L) Radhabinode Choudhury-original allottee in 1969. Dutta then executed a power of attorney in the name of the advocate before leaving Shillong on July 21, 2000 for Kolkata to be with his son. Ranabir taking advantage of the surname filed an affidavit that he is the only grandson of (L) Radhabinode and obtained the lease agreement, by fraud and misrepresentation.
However, on receipt of a complaint, the DC EKH summoned Dutta and Ranabir for a hearing on April 20, 2010. Prabhasini’s son, Biswanath appeared on her behalf and produced an affidavit signed by Anupama Chakraborty – one of the daughters of (L) Radhabinode, which established the fact that Ranabir was no relative of the deceased. And after a hard fought battle, Dutta’s son Biswanath got justice now that the state government has ordered for cancellation of the said plot which exists in the name of Ranabir.
