Champion moves HC for bail

SHILLONG: GNLA chairman Champion R Sangma moved a bail petition before the Shillong Bench of Gauhati High Court on Monday.

Champion’s wife Enritha N Marak filed the bail petition on behalf of her husband.

While admitting the bail petition, Justice PK Saikia sought the case diary pertaining to two cases registered against the GNLA chairman at Nongstoin.

At the same time, Justice Saikia also fixed January 7 as the next date hearing depending on the availability of the vacation bench in Shillong.

Confirming this, the GNLA chairman’s lawyer Sujit Dey said bail petition was moved as his client was not satisfied with the judgement of the Additional District and Session Judge, Nongstoin in which Champion was denied bail.

“We had moved the bail appeal before Additional District and Session Judge as according to Section 167 of the CrPC, the police is supposed to file the chargesheet within 90 days from the day the accused was first remanded to judicial custody,” Dey said.

“If the police failed to file the chargesheet within the period of 90 days, the accused is entitled to be released on bail if he gives surety,” he said.

In the case of Champion, he said the police failed to file the chargesheet even after the expiry of 90 days.

It may be mentioned that the Additional District and Session Judge had rejected the bail appeal on December 10.

On September 3, 2012, Champion was shown arrested at the Shillong district jail itself and court had passed an order of four hours ‘police custody’ and on the same day, on expiry of police custody he was produced again and was then remanded to judicial custody.
