SHILLONG: The proposed Meghalaya Regulation of Landlords and Verification of Tenants Bill, 2013 will put burden on the tenants as they have to file affidavits by paying money to the lawyers.
The land lords will also have to go through the same process.
As per Section 8 (1) of the proposed Bill, every landlord and tenant will be legally bound to furnish within thirty days of letting out or occupying the house or rental unit, several documents to the police station and local authority under whose jurisdiction the area falls.
Among the varied documents, “a residential certificate supported by affidavit in Form A where the tenant previously resided should be submitted”.
Identification by an advocate in the presence of First Class Judicial Magistrate is mandatory for the affidavit to be valid under Form A.
According to sources, for the preparation of an affidavit, the lawyer’s fee ranges from Rs 50 to Rs 1,000.
The advocates usually charge fee in terms of cost for writing and expenditure for paper used for preparation of affidavits.
In additional to Form A, both the landlords and the tenants should fill up another Form B which will include details of information of landlord and tenant for tenancy verification by Police and local authority.
