Ri Bhoi petrol pump ‘functioning illegally’

NONGPOH: Marwet Oil Services Pvt. Limited, a petrol pump located at 9th Mile Baridua, in Ri Bhoi District, has been running amid gross violation of Indian Oil Corporation Limited’s norms and conditions for several years.

According to documents available with The Shillong Times, the petrol pump was set up by one Rosaline Warjri and Manoj Deka Deb Roy as dealers of the Indian Oil Corporation Limited (IOCL) (MD) and for which the IOC Limited, Guwahati Divisional Office issued a partnership letter of intent having Warjri amd Deb Roy as partners for installation of retail outlet/petrol pump on February 22, 2006. The dealership agreement was subsequently issued on March 31, 2010.

According to norms, the land cannot be transferred without the permission from the IOCL, but the land meant for setting up of Marwet Oil Services Pvt. Ltd. was transferred right after the petrol pump was commissioned.

As per IOCL norms, the letter of intent or the dealership is neither transferable nor assignable but according to reliable sources, several persons have joined and retired from the post of Director of the Marwet Oil Services Private Limited without the permission of or intimation to IOCL.

According to sources, the letter of intent was signed by Warjri and Deb Roy with the IOCL on February 22, 2006 but when the dealership agreement was issued to a different party, it indicated illegal change of hands.

As per the dealership agreement, the dealer shall take active part in the management and running of the dealership and shall personally supervise the same and shall not under any circumstances do so through any other person, firm or body either as benami or through any power of attorney or otherwise. However in the case of Marwet Oil Services Limited, there were three power of attornies and a deed of declaration signed and issued, which is totally against the dealership agreement.

It was also learnt that the agreement is particular that the dealer shall not sell, assign, mortgage, sublet and charge or part with or transfer the premises or any part thereof. In the case of Marwet Oil Services Limited, these conditions were also violated.

Shockingly, it has been learnt that the signature and thumb impression of the original dealers namely Warjri and Deb Roy were allegedly forged so as to serve the interest of the persons who intend to grab the Marwet Oil Services Limited through illegal means.

Sources said that Warjri expired on July 16, 2010 and was not in position, physically or mentally, to sign or enter into any agreement few months before her death.

Sources alleged that such illegality cannot be carried on over such a long period of time without the patronage of those at the helm of affairs.
