SHILLONG: The High Court of Meghalaya has directed the stall holders of Jail Road to handover the stalls to the Shillong Municipal Board (SMB).
Earlier, eviction notices were issued to the stall holders by the Chief Executive Officer, SMB for using them for development purposes which, however, was challenged before the High Court of Meghalaya.
Acting Chief Justice T.N.K Singh of Meghalaya High Court by passing a common judgment dated August 19 dismissed the writ petitions and directed the stall holders to hand over the possession of the stalls to SMB within three weeks which is the date fixed by the SMB.
The High Court while dismissing the writ petitions of the stall holders held that, “wherever public interest to such a large extent is involved and it may become necessary to achieve an object which serves the public purposes, individual rights may have to give way.”
The Court further held that the SMB should take necessary steps to recover the arrear fees from the petitioners.
