Agartala:Tripura High Court on Friday issued contempt notice to Law Secretary Datamohan Jamatia and Deputy Law Secretary Shankari Das for misleading the state government in implemen-tation of the order passed by division bench of Guwahati High Court in regard to SC, ST Reserva-tion Rules in 2012.
The full bench of Tripura high court comprising of Chief Justice Deepak Gupta, Justice U B Saha and Justice S C Das while hearing the case on exceptional reservation for scheduled caste and sche-duled tribes in promotion of service found that the state government has been violating the direction of high court.
A division bench of Guwahati high court headed by Justice I A Ansari had imposed a stay order on rule of the Reservation Rules in response to a petition filed by General Officers and Welfare Society on June 2012. The written order had Reservation Act typed instead of Reservation Rules owing to which the Secretary of Law Depart-ment denied to implement the direction passed by the high court.
The court opined in-stead of asking clari-fication from the high court on the typographical mistakes in the judgement, both Law Secretary and Deputy Law Secretary refused to accept the stay order on restrain promotion of SC and ST aspirants in higher post if the SC and ST have adequate represen-tation.
The court asked both the Law secretary and deputy Law secretary to appear before in person at the High Court on November 28 next along with all necessary files.
Meanwhile, the full bench of high court has also finished three days long hearing today on promotion of SC and ST candidates in higher posts, said lawyer of the petitioner General Employees and Welfare Society Kiran Suri and added that the court has reserved the judgement.(UNI)
