Govt notification terming KHADC building laws unauthorised
SHILLONG: Following the State Government’s decision to declare the Khasi Hills Autonomous District (Land Development and Building) Regulation, 2015 as unauthorized, KHADC CEM Pynshngaiñ N Syiem on Sunday said that he would examine if the publication of the Council’s building laws in the Gazette of Meghalaya went against the laid down norms.
“We would have to look into the provisions laid down in the Assam and Meghalaya Autonomous Districts (Constitution of District Council) Rules, 1951. Only after verifying the various provisions of the law will we be able to come to a conclusion on whether the decision of the State Government to declare the Khasi Hills Autonomous District (Land Development and Building) Regulation, 2015 as ‘null and void’ is justified,” Syiem said here on Sunday.
When asked if the State Government had decided to declare the regulation of the Council as ‘unauthorized’ for not following the laid down guidelines before publishing it in the gazette, the KHADC CEM said that he is not very sure about the guidelines mentioned by the State Government.
“I am also not very sure if the Council had abided by these laid down procedures in the past before getting any matter published in the gazette. We would have to do our homework to find out if these laid down procedures were followed in the past,” Syiem said.
He added that he will be seeking the files on Monday to find out the actual position on the matter.
“I will be coming up with an official statement on the matter on Monday,” the KHADC CEM said.
Earlier, the State Government had on Friday issued a notification declaring the “Khasi Hills Autonomous District (Land Development and Building) Regulation, 2015” as “unauthorised”.
The Government notification can be termed as a major setback for the KHADC which had passed Khasi Hills Autonomous District (Land Development and Building) Regulation, 2015 with an objective to regulate construction of buildings in the scheduled areas.
The Government notification had been issued in the wake of the KHADC notifying the “Khasi Hills Autonomous District (Land Development and Building) Regulation, 2015” which was published in Part-IV of the Gazette of Meghalaya (Extra-ordinary) No. 97 dated August 25, 2015.
In the notification issued by the Under Secretary to the Government of Meghalaya, District Council Affairs Department, the State Government declared that the publication of Notification on August 4, 2015 of the Office of the Executive Committee, Khasi Hills Autonomous District Council (KHADC), Shillong in the Gazette of Meghalaya (Extra-ordinary) No.97, dated 25th August, 2015 as unauthorized.
