HC rejects anticipatory bail plea of 11 accused

SHILLONG: The High Court of Meghalaya on Friday rejected the anticipatory bail plea of as many as 11 people named in the FIR filed by the Special Investigation Team (SIT) probing the death of Sub Inspector PJ Marbaniang in Patharkhmah in Ri Bhoi earlier this year.
While rejecting the plea, the Court said that the bail application will be considered only after hearing the investigation officer and perusal of the case diary.
The Court also made it clear that in the event of arrest of the accused in connection with the case, they are to be released on bail on payment of Rs. 50,000 each with one surety in the like amount to the satisfaction of the arresting authority.
The next hearing on the matter will be held on October 26 and the investigation officer has been summoned along with case diary for the same.
Earlier, the counsel for the accused submitted in the court that SI Kynsai Jones Nongkharai, head constable SK Marak and constables Bobin Kalita, Dress Khymdeit, Kamal Ch. Bora, Pdianglad Shangpliang, Thagiram Sharma and Francis Khymdeit- all from Patharkhmah police outpost- were in no way involved in the case and cases have been registered against them without any reason.
In addition, the bail pleas of Assistant Ranger, KHADC Forest check Gate, Paham Range, Homestar Jamu, Ranger, KHADC Forest check Gate Paham Range, Kamphermay Kharsati and one  Andy Robert Basaiawmoit were also rejected by Justice SR Sen.
Earlier, the SIT reached the conclusion that pressure was exerted on Sub Inspector (late) P.J. Marbaniang after he detained 32 coal-laden trucks in Patharkhmah.
The SIT also arrested five persons including a Block Development Officer and members of the FKJGP Western Zone for alleged abetment to suicide.
SIT also filed as many as six FIRs with Nongpoh police against 30 people including government officials and police personnel from Patharkhmah police outpost and the Jirang BDO for illegal collection of money from coal trucks.
