CEM holding dual post
SHILLONG: The State government is yet to send any reply on the queries of Election Commission of India on the legality of holding dual post by the Chief Executive Member P N Syiem.
A Law department official said on Saturday that the reply to the query of the Election Commission is yet to be sent.
Earlier, the Election Commission sought the views of the state government on the appointment of KHADC CEM and other issues.
Sources said that the Election Commission raised the queries in the aftermath of the letter written by Meghalaya Governor V. Shanmuganathan to the former regarding its views on the disqualification of KHADC CEM following the PIL filed on dual post which is pending in the High Court.
The queries were also on how the KHADC chief is removed and also whether he is appointed with salary paid by the state government.
The Election Commission wanted a clarity on whether the KHADC chief comes under office of profit.
Questions were also raised by the Commission whether the state government has the power to remove the KHADC chief.
Earlier, a state election department official said that the office of MDCs does not fall under office of profit as they are elected by the people to the Autonomous District Councils formed under the sixth schedule to the constitution.
