Delay in appointment of EC member
SHILLONG: The Khasi Hills Autonomous District Council (KHADC) has filed a petition on Monday in the High Court of Meghalaya for the delay on the part of the Government in appointing MDC Donkupar Sumer as Executive Committee (EC) member.
The case will come up for hearing on May 18.
Sources said on Monday that the KHADC filed the petition as there was undue delay on the part of the Governor and the Government in appointing Sumer though the KHADC Chief Executive Member P N Syiem had forwarded the name to the Governor for his nod long back.
According to sources, as per the Assam-Meghalaya District Council Rule no. 19 sub rule 1 and Rule 20 sub rule 1, the Governor will appoint the EC member based on the advice of the CEM.
As per norm, the Chief Executive Member (CEM) and 10 MDCs constitute the EC.
Earlier, based on the Assam-Meghalaya District Council rule, the CEM had constituted the EC with nine MDCs including the Deputy CEM after getting nod from the Governor without any delay.
Later on June 17 last year the name of Arbinus Lyngdoh was forwarded to be included in EC and after six days on June 23, the nod for his appointment came from the Governor.
Later, after Donevan Wahlang MDC resigned, it was accepted by the Governor and for the remaining vacant seat, the CEM on March 3 this year sent the name of Sumer for the approval of the Governor ,and a reminder was also sent on April 22, but in vain.
Sources said that since the government has allegedly violated the legal rights of KHADC, the intervention of the Court was sought.
